Terms of Service

Welcome to Vera (the "App" or "Services"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Vera App LLC("Company", "we", "us", or "our") governing your download, installation, registration, and use of the Vera mobile application built for mobile operating systems (including iOS and Android), our website, and any related software, features, tools, or content.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all access, delete the App from your device, and terminate any active accounts.

1. Eligibility and User Representation

By using the Services, you represent, warrant, and covenant that:

  • You are at least 13 years of age. If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • You possess the legal capacity and authority to enter into these Terms.
  • All profile registration and onboarding information you submit is accurate, current, truthful, and complete, and you will maintain its accuracy.
  • Your use of the App will not violate any applicable local, state, national, or international law, rule, or regulation.

2. Description of the Services

Vera is a personalized beauty, cosmetic, and makeup discovery application. The App provides users with tools to:

  • Answer specialized onboarding questionnaires to formulate a personalized beauty profile.
  • Optionally capture or upload photographic selfies for complexion analysis, including skin tone depth, undertone detection, and visible nuance mapping.
  • Receive artificial intelligence (AI)-assisted makeup insights and tailored product recommendations.
  • Engage with interactive swipe-based feeds to like, dislike, or mark products as owned.
  • Curate and search a personal wishlist of cosmetic and beauty products.
  • Access virtual try-on preview tools and submit subjective feedback regarding simulated applications.
  • Click external commerce links to purchase products directly from independent, third-party retailers.

3. Accounts, Authentication, and Profiles

To provide flexibility, Vera supports multiple methods of authentication and account management:

A. Anonymous Access

You may start utilizing the App anonymously through our integration with anonymous authentication features. Anonymous accounts allow you to create a local profile, save beauty preferences, and test virtual try-ons. However, anonymous profiles are tied directly to your active device session. Clearing your app cache, deleting the App, or losing access to your device may result in the permanent loss of all anonymous profile data. We are not responsible for data loss incurred while operating under anonymous sessions.

B. Registered Profiles

You can register a fuller, persistent profile by signing up with an email and password, or via secure third-party login providers. If you create a registered account, you agree to:

  • Keep your authentication credentials, passwords, and access tokens secure and confidential.
  • Immediately notify us of any unauthorized use of your credentials or breach of security.
  • Assume full responsibility for all activities, actions, and uploads that occur under your account.

C. Personal Data Profile Fields

Depending on your usage, we may store and associate with your account: your full name, email address, optional phone number, answers to beauty questionnaires, skin type, specific skin concerns, budget, loved brand selections, specific product interests, style preferences, secure selfie cloud storage directories, search query caches, wishlist items, swipe history, recommendation history, and try-on feedback.

4. Photos, Selfies, and User-Generated Content

The core personalization functionality of Vera is powered by your user-generated content, specifically uploaded or captured photographic selfies and profile pictures.

A. Selfie Storage

When you take or upload a selfie, it is uploaded and stored securely within secure cloud storage databases under unique, user-specific, authenticated paths.

B. Consent to Process and Share

By uploading or capturing a selfie, you grant us explicit, active consent to process your photograph for cosmetic analysis. To generate personalized makeup recommendations and render high-fidelity virtual try-on previews, your selfies may be securely transmitted and processed by our third-party artificial intelligence service and image processing partners.

C. User Warranties on Content

You represent, warrant, and agree that:

  • You own or have obtained all necessary licenses, rights, and permissions to upload, process, and use the selfies.
  • You will not upload any photograph of another individual without their explicit, written, and verified consent. Under no circumstances should you upload non-consensual images.
  • The photos do not contain, promote, or display explicit nudity, sexually suggestive content, violence, hatred, unlawful material, or infringe on any third party's trademarks, copyright, patents, privacy, or proprietary rights.

D. License Grant to Vera

You retain all ownership rights in your selfies and user content. However, by uploading content to Vera, you hereby grant Vera App LLC a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to host, store, process, transmit, reproduce, analyze, modify, and edit your selfies and profile details solelyas necessary to operate, provide, secure, analyze, and improve the App's current features (such as facial skin tone evaluation and try-on graphics generation) and for product R&D. This license terminates when you delete your account or delete the respective photo, subject to standard system backups and data-retention safety policies.

5. Artificial Intelligence (AI) Features & Disclaimers

Vera uses advanced machine learning, computer vision, and generative artificial intelligence APIs to analyze images, map facial attributes, and generate mockups.

CRITICAL AI DISCLAIMER AND LIMITATIONS:
  • Not Precise: AI outputs, skin tone depth assessments, undertone classifications, nuance tags, and virtual try-on preview images are computed simulations. They are for cosmetic exploration, educational research, and entertainment purposes only.
  • Inaccuracies & Variances: The generated shade-matches, product overlays, and recommendation models may be inaccurate, incomplete, outdated, or fail to represent real-world product performance. Lighting conditions, camera resolutions, device display properties, and AI model variations can heavily affect results.
  • No Performance Guarantee: We do not guarantee that a cosmetic product purchased in reliance on a Vera recommendation or virtual preview will match your skin tone, achieve your desired look, or perform as simulated in real life.

6. Skincare & Medical Disclaimer

MEDICAL & HEALTH DISCLAIMER:

Vera is NOT a medical, dermatological, skincare treatment, diagnostic, health, allergy-testing, or professional beauty advisory service.

Our App does not diagnose skin conditions, evaluate dermatological health, check for ingredient safety/toxicology, or provide clinical treatments. Do not use the App's findings as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified medical professional or dermatologist regarding any skin condition, allergic concern, or dermatological regimen. You assume full risk and responsibility for any skin reactions, cosmetic adverse effects, or allergy problems arising from your purchase and application of recommended products.

7. E-Commerce, Affiliate Disclosures, & Third-Party Retailers

Vera is an independent discovery platform and does not directly process checkout, sales, shipping, or payments for beauty products.

A. Redirection to Third-Party Merchants

The App displays product cards containing images, descriptions, pricing, and purchase links. Clicking these links redirects you via mobile browser or in-app web view to independent third-party retailer websites, including Sephora, Ulta, Nordstrom, Macy’s, Target, Amazon, Cult Beauty, Net-a-Porter, Dermstore, Blue Mercury, Space NK, Lookfantastic, Revolve, and brand-specific storefronts like Fenty Beauty, Rare Beauty, Rhode, Charlotte Tilbury, NARS, NYX, Huda Beauty, MAC, e.l.f., Tower 28, ILIA, Glossier, and others.

B. Disclaimer of Retailer Liabilities

Any transaction, checkout, payment, shipment, return, customer service inquiry, or dispute is handled entirely between you and the respective third-party retailer. We exert no control over, and assume absolutely no responsibility or liability for, the pricing, availability, product description accuracy, ingredient safety, shipping terms, return policies, or quality of products purchased from external merchants.

C. Affiliate Commission Disclosure

In compliance with Federal Trade Commission (FTC) guidelines, please be advised that Vera App LLC may participate in affiliate marketing programs. This means that we may utilize affiliate tracking links, and we may earn referral commissions, fees, or advertising revenues when you click links within the App to visit external retailer storefronts and complete a purchase. These affiliate relationships do not increase your purchase price or alter retailer terms.

8. Device Permissions and Network Access

To provide its core personalized features, the Vera mobile application requires specific technical permissions on your mobile device:

  • Camera Access: Utilized to capture real-time selfies or profile photos directly from the App for dynamic complexion matching and virtual try-ons.
  • Photo Library Access: Utilized to select pre-existing photos or selfies from your device library to load into your beauty profile.
  • Notifications: Optional authorization allowing the App to deliver reminders, notifications to refresh beauty profiles, or cosmetic release updates.
  • Internet & Network Access: Required to establish secure server communications, authenticate user sessions, process artificial intelligence and virtual try-on requests, run search queries, gather product analytics, and redirect to purchase URLs.

You may enable, disable, or modify these permissions at any time through your device system settings, though disabling certain permissions may render core App features non-functional.

9. Account Deletion and Data Retention

We respect your data privacy and control. You have the right to delete your account at any time directly from the settings interface within the App.

Upon initiating account deletion, Vera will automatically execute a hard-deletion cascade:

  • Your personal Vera user profile and questionnaire metadata are wiped.
  • Your corresponding user authentication profile records are permanently removed.
  • All stored selfie image files located in your cloud storage directories are deleted.
  • Your user wishlist, swipe history, recommendation history, feed tracking states, and try-on feedback logs are cleared.

Please note that while database deletion is immediate, some residual data (such as anonymized analytical events, system logs, or aggregated feedback records) may persist in backup databases, security snapshots, or analytical logs for legal compliance or security purposes. Certain third-party service providers may also retain processing logs for a limited period in accordance with their respective compliance policies.

10. Prohibited Activities

You agree not to engage in any of the following restricted behaviors while using the Services:

  • Using the App or any AI features to analyze, store, edit, or generate non-consensual images of other individuals.
  • Using the App for any illegal, harassing, deceptive, stalking, harmful, or defamatory activities.
  • Attempting to bypass, disable, reverse engineer, decompile, or circumvent any security measures, model weights, API protection tokens, or rate-limiting features of the App or its AI systems.
  • Automating access to the Services through scrapers, spiders, crawler bots, or bulk image upload tools without our prior written authorization.
  • Uploading software viruses, malware, or any code designed to disrupt, damage, or compromise the App infrastructure.
  • Exploiting recommendation logs or AI generation tools to create competing machine learning models, beauty databases, or commercial shade-matching services.

11. Limitation of Liability and Disclaimer of Warranties

THE SERVICES AND ALL ASSOCIATED RECOMMENDATIONS, DISCOVERIES, IMAGES, AND PREVIEWS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, VERA APP LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY THIRD-PARTY RETAILER PRODUCTS, PRICE DIFFERENCES, ACTIONS, OR INGREDIENT CONCERNS; (III) ANY INACCURACY IN THE AI SHADE-MATCHING OR VIRTUAL TRY-ON MODEL PREVIEWS; OR (IV) ANY USER CONTENT OR SELFIE REMOVAL. IN NO EVENT WILL THE AGGREGATE LIABILITY OF VERA APP LLC EXCEED THE GREATER OF TWENTY U.S. DOLLARS ($20.00) OR THE TOTAL AMOUNT PAID BY YOU TO VERA, IF ANY, IN THE PAST SIX MONTHS.

12. Governing Law and Dispute Resolution

These Terms and your relationship with Vera App LLC shall be governed by, and construed in accordance with, the laws of the State of Delaware, United States of America, without regard to its conflicts of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding, individual arbitration in accordance with the American Arbitration Association (AAA) rules, rather than in court, except that you may assert claims in small claims court if eligible.

13. Changes to These Terms

We reserve the right to modify, amend, or replace these Terms of Service at any time. When we make updates, we will post the revised terms within the App or on our website and update the "Last Updated" date at the top. Your continued use of the App following the posting of modifications indicates your active acceptance of the updated Terms.
